TERMS OF SERVICE
1. General
- I have the right to decline commissions I feel uncomfortable doing or unable to do.
- Clients will only be receiving "digital" goods. Meaning there will be no shipping of any physical goods.
2. Payment
- All commissions must be paid full, upfront. I will not start the drawing before.
- Do not pay me until I have accepted your commission.
- Payment will be taken via paypal invoice (EUR €).3. Commission Process
- I will start after payment is made.
- Depending on my schedule, I cannot exactly say when a commission will be finished. Live2D art can take longer. The commissioner's participation will affect the time of completion.
- Commission order -> (if accepted) payment -> sketch -> feedback (the commissioner will be shown a flat, colored or not, sketch. Any fixes will be made here) -> color -> edit -> finished picture will be sent via email -> additional edits (details I accidentally left out that were in the original reference when ordering will be edited free of charge). Other edits than color adjusting will be either charged or not accepted depending on the complexity.
- If you do not wish to see the sketch, state it in your order beforehand.4. Copyright / Usage Policy
- I, Mashiro, hold all copyright to the produced artwork, not the commissioner, unless otherwise stated.
- I will have the right to upload and stream the process/finished piece to any of my social networks.
- Do not use my works for bases/tracing/rendering/AI...
Commissioners are allowed to:
- Use their commissioned works for personal use only unless agreed otherwise. Commercial goods will be charged for more.
- Print the art for themselves, and claim the right to their character(s) but not the drawing itself.
- Use the art to promote themselves with permission and proper credit given to the artist. Examples being profile icons / banners / Twitch buttons etc. Ask permission if you are going to edit it in any way to fit a banner etc. Otherwise proper credit will be enough.
The following is considered copyright infringement:
- Reproducing / using my artwork commercially (making money off of it by any means unless agreed otherwise).
- Taking credit for my artwork, or giving none at all.
- Removing my watermarks / signature.
- Editing / altering the artwork itself without my permission.
- Feeding my artwork into image generation models.
If you break the copyright infringement in any way, every right you had to the drawing will be retracted.5. Cancellation and Refund Policy
- I have the right to cancel and refund the money for your commission at any time.
- In the event of cancellation or breach by the client, I shall retain ownership of all rights of copyright and the original artwork, including sketches and any other preliminary materials. I have the right to use these materials for my own purposes or for future commissions.
- The commissioner will have no right to cancel or demand a refund from the artist under any circumstances after payment is received and the sketch confirmed.
- If money has not been sent, the commissioner has the right to cancel the commission.
